Pour une Veritable Concertation sur les Enjeux et Objectifs d’une Reforme Fonciere au Senegal / Towards real Dialogue on the Issues and Objectives of Land Reform in Senegal

“Senegal’s National Domain Law was passed in 1964 with the aim of ensuring all citizens standardised management of and equal access to land. This law was not, however, without its limitations, which have had negative consequences on the country’s land distribution policies. Today, this law is not entirely upheld and represents two management models (traditional and modern) which have come to overlap. The political vision that inspired this law has evolved to adapt itself to the diverse issues which have emerged over the years, and different tools are used to address issues surrounding land management, notably that of the Senegalese Land Use and Allocation Plan (POAS), and of the Charter for Irrigated Areas (CDI). These tools will not, however, resolve the problems created as a result of the inadequacy of Senegal’s land laws. Furthermore, stakeholders are not in agreement vis-à-vis the meaning and interpretation of land reform. It is thus argued that consensus on the aims and objectives of land reform can only be reached through increased dialogue and cooperation. / Au Sénégal, la loi sur le domaine national votée en 1964 devait permettre une gestion homogène des terres par tous les citoyens sénégalais et un accès équitable à la terre. Cependant cette loi présentait des insuffisances qui ont entraîné des dérives. Aujourd’hui, elle n’est plus vraiment respectée par tous et c’est ainsi que deux modèles de gestion (traditionnel et moderne) se superposent. La vision politique à la base de cette loi a évolué afin de s’adapter aux divers enjeux qui ont progressivement émergé. Différents outils vont être élaborés en fonction des enjeux, notamment les Plans d’aménagement et d’occupation des sols (POAS) et la Charte du domaine irrigué (CDI). Ces outils ne vont toutefois pas permettre de résoudre les problèmes posés par l’inadéquation de la législation foncière. En outre, tous les acteurs impliqués ne s’accordent pas sur le sens à donner à une réforme foncière. En conséquence, une concertation est nécessaire afin d’arriver à une vision commune par rapport aux enjeux et aux objectifs d’une telle réforme.”
